Car accidents involving pedestrians may prove fatal

A pedestrian passed away in a tragic motor vehicle accident in Texas. The accident occurred on a Monday night. Now, the individual’s surviving loved ones are left to grieve and wonder how such tragic car accidents can happen.

The pedestrian collision occurred along Interstate 35E at around 11:30 p.m. Police said that witnesses reported to them that a car had been headed north along the highway. However, it suddenly veered off of the interstate.

The car then went over a service road’s northbound lanes and came to a stop in an area covered with grass, near a business. The pedestrian ended up being struck and killed when the car left the highway suddenly. The individual driving the car that struck the pedestrian suffered injuries in the collision and thus was taken to the hospital.

The surviving family members of the pedestrian may choose to file a wrongful death claim against the car driver if driver negligence is found to have caused the Texas accident. For example, perhaps the driver was speeding at the time of the crash, or maybe he or she was operating the car while distracted on a cell phone. Competent proof of negligence is required to establish liability before the civil court in cases involving these types of car accidents. Only then will a judge decide claims for financial damages. A monetary award in a successfully fought case cannot undo the tragic events that lead to the pedestrian’s death, but it may help to address funeral costs and enable the surviving loved ones to more easily move on from the ordeal.
