Fatal car accidents may stem from drinking and driving

Two people’s lives have sadly been cut short in a motor vehicle crash in Texas. Now, their loved ones are left wondering how these types of tragic car accidents can happen. However, a county medical examiner recently reported that the crash, which occurred in late 2018, was unfortunately the result of one of the two parties’ decision to drink and drive.

According to authorities, the two individuals — a 28-year-old man and a 26-year-old woman who were dating — were traveling in a car at a little past midnight on a Sunday. However, the man, who was driving at the time, reportedly left the roadway and entered the median. Police said the car then went over a creek and struck an embankment.

The two individuals ended up passing away in the collision. According to authorities, the man’s blood alcohol content was .23 when the crash happened. That is almost triple Texas’ legal limit of .08.

In light of the medical examiner’s news, the surviving loved ones of the woman who passed away in the crash may decide to file a wrongful death claim, seeking the reimbursement of damages. Even though the man who allegedly caused the crash passed away in it, his estate may be sued. In addition, anyone else with an ownership interest in the car he was operating may be named in the suit. If the plaintiff is successful in the wrongful death lawsuit, he or she may receive a monetary damage award that might help with addressing funeral costs and other losses stemming from these types of car accidents.
