Head-on car accidents may result from failure to stay in lane

Sadly, two individuals lost their lives in a tragic motor vehicle accident in Texas. The collision took place along U.S. 377 on a Monday night. Sometimes car accidents occur due to the carelessness of a motorist, in which case, this motorist may be held liable in civil court.

According to authorities, a 59-year-old woman and a 36-year-old man passed away in the recent Texas accident. Police said the woman’s car breached the center lane of the road. That is when it apparently hit the man’s car head on.

Both the man and the woman died at the accident scene. Police reported that a third driver was also involved in the accident; however, this driver did not contribute to it. The accident ended up closing both directions of the highway temporarily. Authorities continued to investigate the circumstances surrounding the crash.

The surviving loved ones of the man who passed away in the Texas accident may decide to file a wrongful death claim, seeking the reimbursement of monetary damages sustained in the crash. Even though the woman who reportedly caused the head-on crash ended up dying, her estate may still be sued. In addition, anyone else who had an ownership interest in the car she was driving may be named in the wrongful death lawsuit. A preponderance of the evidence is necessary to establish liability, based upon a showing of negligence, before the court hearing the case. Only then will claims for damages associated with these types of car accidents be adjudicated.
